Welcome to the **DDRiVE-M Platform**.

These Terms of Use ("Terms") govern your access to and use of the DDRiVE-M digital risk management platform (the "Platform"), owned and operated by Cognitio Plus Consulting, or its authorized partners ("We," "Us," or "Our"). By accessing or using the DDRiVE-M Platform, you ("You," "Your," or "Client") agree to comply with and be bound by these Terms in full. If you do not agree with any part of these Terms, please refrain from using the Platform.

1. Definitions

- "Client," "You," or "Your"** refers to any individual or organization accessing or using the DDRiVE-M Platform.

- "The Company," "We," "Us," or "Our"** refers to the owner and operator of DDRiVE-M.

- "Platform"** refers to the DDRiVE-M web application accessible at [https://ddrive-erm.aiwaapp.live](https://ddrive-erm.aiwaapp.live), including all subdomains, features, content, and integrated services (e.g., GeomapperPH, HazardHunterPH, GeoanalyticsPH).

- "Parties" refers collectively to both the Client and the Company.

All references to gender, number, or person shall be interpreted interchangeably and inclusively.

2. Acceptance of Terms

Your use of the DDRiVE-M Platform constitutes your acceptance of these Terms, our Privacy Policy, and any applicable addenda or notices. These Terms apply to all visitors, users, and others who access or interact with the Platform.

3. Use of Cookies and Tracking Technologies

We use cookies and similar tracking technologies to enhance user experience, enable authentication, maintain session state, and analyze non-identifiable usage patterns. By using the Platform, you consent to the use of cookies in accordance with our Privacy Policy. Third-party analytics or mapping services (e.g., HazardHunterPH, DOST-PHIVOLCS APIs) may also deploy cookies as part of their integrated functionality.

4. License and Intellectual Property

Unless otherwise stated:

- All content, software, logos, interface designs, data visualizations (including D3.js components), documentation, and functionality on the DDRiVE-M Platform are the exclusive property of the Company or its licensors.

- You are granted a **limited, non-exclusive, non-transferable, revocable license** to access and use the Platform for internal organizational risk management purposes, in compliance with Philippine laws and DRRM regulations (e.g., RA 10121).

You must not:

- Republish, sell, rent, sublicense, or redistribute any portion of the Platform;

- Reverse engineer, decompile, or attempt to extract source code;

- Use automated scripts or bots to scrape data;

- Remove or alter copyright or proprietary notices;

- Use DDRiVE-M branding, logos, or interface elements without express written permission.

5. User Responsibilities & Content

While the DDRiVE-M Platform does not currently host public comment sections, users may input organizational data, risk assessments, plans, or annotations ("User Content"). You warrant that:

- You have the right and authority to submit such content;

- The content does not infringe third-party rights;

- It complies with applicable laws, including the Data Privacy Act of 2012 (RA 10173);

- It does not contain defamatory, unlawful, or malicious material.

By submitting User Content, you grant the Company a non-exclusive, royalty-free, worldwide license to use, store, process, and display such content solely to provide and improve the Platform.

 6. Third-Party Integrations

DDRiVE-M integrates with government-operated hazard data platforms such as **HazardHunterPH** ([https://hazardhunter.georisk.gov.ph](https://hazardhunter.georisk.gov.ph)), GeomapperPH, and GeoanalyticsPH. These services are governed by their own terms and privacy policies. The Company makes no warranties regarding the accuracy, completeness, or availability of third-party data but uses it in good faith to support location-based risk assessments as permitted under DOST-PHIVOLCS guidelines.

7. Hyperlinking Policy

You may link to the DDRiVE-M Platform’s homepage or public pages under the following conditions:

- The link must not misrepresent affiliation, sponsorship, or endorsement;

- It must not appear in a context that is defamatory, obscene, or illegal;

- It must not use DDRiVE-M’s logo or branded assets without written consent.

Government agencies, academic institutions, DRRM practitioners, and accredited partners may request formal linking approval by emailing hello@cognitioplus.com with:

- Organization name and contact details;

- Intended link URL(s);

- Purpose of the link.

We reserve the right to revoke linking permission at any time.

8. Prohibited Activities

You agree not to:

- Attempt unauthorized access to the Platform or its data;

- Disrupt or interfere with Platform operations;

- Upload malware or engage in phishing;

- Use the Platform for unlawful purposes or in violation of Philippine DRRM or data privacy laws.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DDRIVE-M PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

While we strive for accuracy—especially in risk scores, compliance indicators, and hazard overlays derived from official sources—we do not guarantee the completeness, timeliness, or suitability of the Platform’s outputs for operational decision-making without professional validation.

10. Limitation of Liability

To the fullest extent allowed by law, the Company shall not be liable for:

- Indirect, incidental, or consequential damages;

- Loss of data, profits, or business opportunities;

- Errors in risk assessments or plan recommendations generated by the Platform.

This limitation does not apply to:

- Death or personal injury caused by negligence;

- Fraud or willful misconduct;

- Any liability that cannot be lawfully excluded under Philippine law.

11. Modifications & Termination

We reserve the right to:

- Modify these Terms at any time (notice will be posted on the Platform);

- Suspend or terminate access for violations of these Terms;

- Update or discontinue features, integrations, or services.

Your continued use after such changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts in [Manila or your registered office location, if applicable].
